Digital Omnibus on AI
Regulation (EU) 2026/1744, in force since 27 July 2026, which amended the EU AI Act: it postponed high-risk obligations, rewrote the AI literacy duty and added new prohibited practices.
The Omnibus reset EU AI Act planning: Annex III high-risk duties moved 16 months later, while transparency duties, AI literacy and the new bans follow separate dates, so compliance roadmaps, contracts and vendor questionnaires written against the original timeline need updating.
A provider of a credit-scoring model, an Annex III use case, moves its high-risk compliance milestones to 2 December 2027, keeps its AI literacy measures running under the amended Article 4, and updates customer contracts that still cite the original 2 August 2026 date.
It postpones but does not remove high-risk obligations, and systems placed on the market before the new dates come into scope if they are substantially modified afterwards. Summaries and unofficial consolidated texts vary, so obligations should be checked against the text published in the Official Journal.
The Commission proposed the Digital Omnibus on AI on 19 November 2025; it was published in the Official Journal on 24 July 2026 and entered into force on 27 July 2026. It moves obligations for Annex III High-Risk AI Systems from 2 August 2026 to 2 December 2027, and for high-risk AI in Annex I products to 2 August 2028. It replaces Article 4 with a duty to take measures that support AI Literacy, without guaranteeing a level for any individual, and adds bans on AI that generates non-consensual intimate imagery or child sexual abuse material from 2 December 2026. It also extends simplified rules to small mid-cap companies and gives the AI Office exclusive supervision of AI systems built on a provider's own general-purpose AI models.
